Contract of carriage

NOTIFICATION

For carriage having a destination or stop outside the country of departure, the provisions of the Russian legislation, international treaties and agreements of the Russian Federation, as well as conventions in the field of international air transportation, including the Montreal Convention on the Unification of the Rules of International Air Transportation, which establish a limited Carrier's liability to passengers.

TERMS OF AN AGREEMENT

  • The terms used in this agreement mean: “Ticket” - this passenger ticket and baggage receipt, or this route / receipt, if applicable, in the case of an electronic ticket, of which these conditions and notices are part; “Carrier” - all air carriers that carry or undertake to carry a passenger and his baggage under this agreement or perform any other service associated with this air transportation; “Electronic ticket” means the Itinerary / Receipt issued by or on behalf of the carrier, Electronic Coupons and, if applicable, a boarding document; “Montreal Convention” - Convention for the Unification of the Rules of International Air Transport, signed in Montreal on May 28, 1999.
  • Carriage carried out under this contract is subject to the liability rules established by the Montreal Convention, unless carriage is not “international carriage”, as defined by this convention. When resolving disputes arising between the Airline and a passenger from an international air transportation agreement, the law of the Russian Federation is applicable.
  • Since this does not contradict the foregoing, carriage performed under this contract and other services provided by each carrier are subject to: (i) the conditions set forth in this ticket; (ii) applicable tariffs; (iii) the conditions of carriage and related rules that are part of this document (which can be found at any carrier’s office), with the exception of carriage carried out in the United States or Canada, and territories outside these countries where tariffs apply, operating in those countries.
  • The name of the carrier in the ticket may be indicated abbreviated. The full name and its reduction is contained in the tariff directories, conditions of carriage, the rules and schedule of the respective carrier. The carrier's address is the airport of departure indicated on the ticket opposite the first abbreviated name of the carrier. Agreed stopping points are considered to be points indicated on this ticket or indicated in the carrier’s timetable as stopping points on the passenger’s route. Carriage carried out under this agreement by several successive carriers is considered as a single carriage.
  • A carrier issuing a ticket for carriage on the air lines of another carrier acts as an agent of the latter.
  • Any exclusion or limitation of the carrier’s liability extends to agents, employees or representatives of the carrier, and any person whose aircraft is used for transportation by the carrier and agents, employees or representatives of that person.
  • Checked baggage is issued to the bearer of the baggage tag. In case of damage to baggage during international transportation, a notice must be presented to the carrier in writing immediately upon detection of damage, but no later than 7 days from the date of receipt of baggage. In case of delay in delivery, the notice must be presented no later than 21 days from the date of baggage claim. See rates and conditions for non-international transport.
  • The validity period of this ticket is set for one year from the date of issue, unless otherwise specified in this ticket, tariff directories, conditions of carriage or relevant rules. The carrier may refuse to transport if the prescribed tariff has not been paid.
  • The carrier undertakes to take all measures depending on him to carry the passenger and baggage in a reasonable time. The time indicated in the schedule and other documents is not guaranteed and is not an integral part of this agreement. The carrier may, without warning, transfer the passenger for transportation to another carrier, replace the aircraft, change or cancel boarding at the points indicated on the ticket, if necessary. The carrier is not responsible for ensuring the connection of flights.
  • The passenger must comply with the requirements of state authorities regarding movement to present entry, exit and other necessary documents and arrive at the airport by the time appointed by the carrier, if this time is not set, then by the time sufficient to complete the pre-flight formalities. Responsibility for non-compliance with the visa regime rests with the passenger.
  • None of the agents, employees or representatives of the carrier are entitled to amend or cancel the provisions of this contract.
  • Subject to certain conditions, a simplified procedure for customs operations may be applied, according to which: baggage can be checked-in to the final destination only if there are no goods in it subject to customs declaration in writing. Please note that the application of this procedure does not exempt the transfer / transit passenger: from other requirements of the customs legislation of the Customs Union and the legislation of the Russian Federation on customs; from liability for violation of the customs legislation of the Customs Union and the legislation of the Russian Federation on customs.

PASSENGER NOTICE OF LIABILITY LIMITATION

Passengers whose carriage has a destination or stop outside the country of departure are notified that the provisions of international treaties can be applied to the whole carriage, including any part of it that is entirely within the territory of the country of departure or destination.

The Carrier’s liability for damage caused by the passenger’s carriage of his life or health is determined by the Air Code of the Russian Federation, international treaties of the Russian Federation or, if the passenger’s carriage by air does not provide for a higher amount of compensation for this harm, in accordance with civil law.

The carrier shall provide compensation in respect of compensation for damage caused during the air transportation of the life of an aircraft passenger to citizens entitled to compensation in case of death of a breadwinner in accordance with civil law, in the absence of such citizens to the parents, spouse, children of the deceased passenger of the aircraft, and in the event of the death of a passenger of an aircraft who did not have an independent income, to the citizens with whom he was dependent, in the amount of two million rubles.

Additional security is usually provided by the passenger through insurance with an insurance company. Such insurance is not affected by any limitation of the carrier's liability under the Conventions or a special contract of carriage. LUGGAGE LIABILITY NOTICE

With the exception of declaring baggage in advance of increased value with payment of an additional fee, liability for loss, damage or delay of baggage for most international transport is limited to the size determined by the Conventions in the field of international air transport.

In case of domestic air transportation, the Carrier’s liability for loss, shortage or damage (spoilage) of baggage accepted for air transportation without declaring value shall be established in the amount of their value, but not more than six hundred rubles per kilogram of baggage weight. For loss, shortage or damage (spoilage) of things that are with the passenger - in the amount of their value, and if it is impossible to establish it - in the amount of not more than eleven thousand rubles.

NOTICE OF GOVERNMENT TAXES, FEES AND DUTIES

The price of this ticket may include taxes, fees and duties that the government levies on air transport. These taxes, fees and duties, which may comprise a certain part of the cost of the flight, are included in the ticket price or are indicated separately in the column “SECTION” of the ticket. You may also be asked to pay taxes, fees or duties that have not yet been received.
